Insurers Fight Bad Faith and Lawsuit Abuse
This year the trial bar is aggressively pushing an agenda that would encourage more lawsuits and raise insurance rates for consumers and businesses. The trial bar is supporting bills across the country that would make it easier to bring suits, recover damages and collect more attorney’s fees. Of particular note this year is activity surrounding bad faith legislation.

Although insurers have a strong track record of service and satisfaction, and states have solid unfair claims handling laws and regulations on the books, the industry is currently under attack from the trial bar as it seeks to expand its ability to bring lawsuits when there are disputed insurance claims. Civil Justice and Tort Reform
Year after year, consumer frustration with the judicial system continues to grow. All the while, higher litigation costs are borne by consumers. For example, insurers are forced to spend millions of dollars every year to fight frivolous lawsuits. These costs increase the price of insurance and a host of other products and services. In essence, this results in the average American family paying a ‘tort tax’. Without reform these costs will continue to spiral out of control.
